The federal agency filed 97 discrimination lawsuits in the fiscal year that ended Wednesday, according to the report by Chicago-based law firm Seyfarth Shaw. That’s roughly in line with numbers from fiscal years 2024 and 2025, but prior administrations routinely filed more than 100 suits, and more than 300 in the early 2000s. The EEOC “had all the ingredients for a blockbuster year” when the commission achieved a quorum and picked a permanent chair, “but the anticipated EEOC filing surge never materialized,” according to the report. In early 2025, President Trump removed two Democrats on the five-person commission. Brittany Bull Panuccio was confirmed in October 2025, restoring the quorum. Disability remained the most common area of litigation, with 38 suits alleging issues such as medical barriers to employment, inflexible leave policies and discrimination against employees with mental health conditions or hearing and visual impairments, the report said. The agency filed 16 suits with religion-based claims and 14 suits based on pregnancy. It filed 15 cases based on race or national origin. In a departure, several of these cases involved discrimination against whites or U.S.-born workers. There were no cases on behalf of LGBTQ workers. “Religious rights, pregnancy-related issues, disability accommodations, and discrimination claims against majority groups remain areas of significant enforcement focus for this era of the Commission,” the report said. “Conversely, issues such as age discrimination, equal pay enforcement, retaliation and LGTBQ-related workplace issues are topics that appear to be taking a back seat under the current Administration.” Related News Lyft to pay $272.5 million to settle California misclassification claims October 1, 2026 New insurance coverage law firm forms out of Wiley Rein October 1, 2026 Missing billing proof stalls medical benefits in mold claim: Judge October 1, 2026 Parametrics firm hires former Allianz cyber leader October 1, 2026 ICC, Axa cut ties amid Trump campaign against court October 1, 2026 Court dismisses intentional-tort claims in propane explosion October 1, 2026 USI launches property facility October 1, 2026 CNA unit must cover COVID-era fraud settlement: Court October 1, 2026 Saudi-linked tanker war risk premiums triple October 1, 2026 Facebook-f X-twitter Linkedin-in Business Insurance is a singular, authoritative news and information source for executives focused upon risk management, risk transfer and risk financing.
