Tony Evers. The agreed-upon reforms in AB 651 would also reverse a state high court decision allowing stacking disability percentages and would clarify that the 12-year filing deadline for occupational disease claims can’t be tolled indefinitely. The measure also would expand Wisconsin’s supplemental benefit program, which provides additional payments to workers with older permanent disability awards whose benefit rates lag behind current levels. Another provision would expand the types of first responders allowed to file claims for post-traumatic stress disorder that are not accompanied by a physical injury. Legislation enacted in 2021 allowed full-time firefighters and police officers diagnosed with PTSD to get treatment for up to 32 weeks from the date the injury was first reported. AB 651 would allow part-time and volunteer firefighters, as well as emergency medical responders, to pursue so-called “mental-mental” claims. The bill would also clarify that the 12-year filing deadline for occupational disease claims cannot be paused indefinitely, even if a case remains open for administrative or procedural reasons. AB 651 includes several provisions that would increase penalties for employers that fail to comply with coverage requirements. The bill would also reverse the 2007 Wisconsin Supreme Court decision in DaimlerChrysler v. Labor and Industry Review Commission that allowed “stacking” permanent partial disability awards. Labor and employer representatives on the Workers’ Compensation Advisory Council agreed on the provisions in the bill last year after lawmakers included a provision authorizing a work comp fee schedule for hospital services in a bill to enact the budget, according to a report by Wisconsin Watch. The Senate voted 32-1 to pass the bill Feb. 11, and the Assembly voted 97-0 to pass it Jan. 20. The governor will have six days from transmittal to sign, veto or allow the bill to take effect without his signature. WorkCompCentral is a sister publication of Business Insurance.
