In California, A.B. 1898 would require employers to provide written notice when a workplace AI tool is used to make or substantially assist in employment-related decisions or to surveil employees. Employers would have to disclose the type of data collected, the decisions affected and maintain an updated list of AI tools in use, providing it annually to workers. The bill authorizes enforcement by the Labor Commissioner and allows for civil penalties. In New York, A. 10251 would establish a new article of labor law governing “automated decision systems.” Employers would be required to provide advance notice before deploying such systems and notify job applicants if automated tools will be used in hiring. The proposal would prohibit employers from relying solely on automated systems for decisions related to discipline, termination or worker “deactivation,” instead requiring human review where automated outputs play a central role. Rhode Island’s H. 7767 would regulate employer use of artificial intelligence and electronic monitoring tools. The bill would require prior written notice to employees, limit monitoring to defined business purposes and mandate an impact assessment in certain circumstances. It also includes anti-retaliation provisions tied to AI-driven employment decisions. All three measures remain in committee and are in the early stages of the legislative process.
