In Travelers Casualty and Surety Company of America and Philadelphia Indemnity Insurance Company v. Blackbaud Inc., the state’s high court reversed a lower court’s decision that had rejected the insurers’ lawsuit. The dispute stems from a 2020 cyberattack in which hackers accessed Charleston, South Carolina-based Blackbaud’s systems for months and stole donor data from nonprofits and educational institutions that used Blackbaud’s software. After the breach, Blackbaud’s clients conducted their own investigations and remediation efforts, including hiring forensic firms, consulting lawyers, notifying donors, and providing credit monitoring services. Blackbaud’s insurers paid more than $2 million for those expenses and then sued Blackbaud to recover the money. A Delaware Superior Court judge found that the insurers did not provide sufficient detail for each policyholder and did not adequately allege that Blackbaud’s conduct caused the losses. The Supreme Court disagreed, holding Friday that the insurers met Delaware’s notice-pleading standard by identifying the common contracts the clients had with Blackbaud and outlining the company’s alleged failures to safeguard data and respond properly to the breach. The court remanded the case for further proceedings.
