Christina Hamilton sought death benefits after her husband died from injuries sustained in a June 2024 automobile accident in Scioto County. She alleged the accident occurred in the course of his employment with a Kentucky-based company, according to Hamilton v. Bridgeport Equipment & Tool Ltd. After her claim was denied administratively, Ms. Hamilton appealed in Lucas County. The employer sought dismissal or, alternatively, transfer to Scioto County. The Bureau of Workers’ Compensation also requested a transfer, but the trial court dismissed the appeal for lack of jurisdiction. The Sixth District Court of Appeals agreed that Lucas County lacked jurisdiction but found that Ohio’s workers comp statute required transfer to a county with jurisdiction. The court reversed and remanded with instructions to transfer the case to Scioto County. It did not decide whether Ms. Hamilton was entitled to death benefits.
