The number of artificial intelligence-related suits continued to grow, with 18 filings so far this year already exceeding the 17 cases filed in all of 2025, according to the report released Wednesday by National Economic Research Associates, a Marsh unit. Pump-and-dump cases – in which shareholders accuse company leaders of failing to disclose share price manipulation — also increased sharply, with 11 cases filed in the first half. Cryptocurrency-related cases declined to a five-year low. A total of 118 new federal class actions were filed in the first half. If the filings continue at this pace, then there will be 236 cases, three cases above the most recent peak in 2023 (see chart). Most of these cases were “standard” securities fraud cases, rather than mergers and acquisitions-related filings, NERA said. Average settlement values reached $54 million, their highest since 2017, adjusted for inflation and excluding billion-dollar settlements. The median settlement was $18 million; median settlements have been relatively stable since 2018, mostly hovering in the mid-teens. Fifty-four percent of cases were filed against technology and health technology and services companies. Forty-five percent of filings included allegations of misleading future performance, the most common allegation. Securities class action trends influence the market for directors and officers liability insurance, which at mid-year renewals remained highly competitive.
