Donnell Perry suffered serious injuries when a vehicle struck him while he was returning from an authorized trip across a highway to buy a phone charger and cigarettes. Hospital testing detected alcohol in his blood, according to Safe Zone v. Perry. An administrative law judge awarded benefits and rejected the employer’s intoxication defense. The Workers’ Compensation Board and Court of Appeals upheld compensability. The employer argued that the statute addressed substances capable of impairing mental or physical capacities and should include alcohol. The Supreme Court found that a 2018 amendment replaced broader intoxication language with provisions covering illegal, nonprescribed substances and prescription substances taken in excessive amounts. Alcohol falls outside those categories. The court also found that the evidence did not require a 15% benefit reduction for an alleged safety violation. The court affirmed, leaving intact a limited remand for clarification of permanent partial disability benefit calculations.
