S.B. 1073, referred to the Senate Judiciary Committee, would repeal state-specific statutes that require a person to sign a written contract, retain control over the result of the work and satisfy other criteria to be classified as an independent contractor. The bill would declare that the classification of all workers shall be determined by the Internal Revenue Service’s test, which stems from a 1987 ruling that identified 20 factors to determine who has the right to control the manner and means of the work.
