The ruling, Zachman v. Markel American Insurance Co., came from Judge Donald M. Middlebrooks of the U.S. District Court for the Southern District of Florida. Markel American is a unit of the Richmond, Virginia-based Markel Group, and MV Realty, a company founded by Ms. Zachman after she appeared on the show, is based in Palm Beach County, Florida. Ms. Zachman competed as Amanda Zuckerman on the CBS reality show’s 15th season in 2013. Her company’s “Homeowner Benefit Program” paid homeowners a small upfront cash sum in exchange for locking them into a 40-year contract requiring MV Realty to be their listing broker, with steep fees if they backed out. Even if the homeowners were foreclosed on or their heirs tried to sell the home, MV Realty demanded 3% of the property’s value, according to the Florida attorney general. Florida’s attorney general sued MV Realty in November 2022, and several other states followed. A state court later found the contracts “substantively unconscionable” and held Ms. Zachman and fellow MV Realty employees Antony Mitchell and David Manchester individually liable for deceptive trade practices. The management liability policy at the center of the coverage dispute, issued by Markel American to MV Realty, ran for a year from August 2022. When MV Realty sought coverage under the policy for the Florida lawsuit, Markel American pointed to more than 40 notices, subpoenas and consumer complaints, some dating to 2019, that it said should have been disclosed and denied the claim. Judge Middlebrooks agreed that many of those notices counted as “claims” under the policy and found they were closely tied to the lawsuit filed during the policy period. He also pointed to “several” exclusions that “would likewise bar coverage” such as an exclusion for profits to which the insured was not legally entitled. In December, a Florida judge levied $18 million in fees and penalties against MV Realty. Several other states have also banned the company, which filed for bankruptcy.
