A federal court in Florida on Monday dismissed with prejudice a copyright lawsuit accusing the pop star of borrowing from a poet’s work for more than a dozen songs, Global News reported. The lawsuit also targeted her record label, Republic Records, and its parent, Universal Music Group Inc., alleging that the defendants infringed the poet’s work by creating videos, performing songs and promoting concerts with derivative material. Among the claimed similarities: “desire as fuel and fire,” being submerged under water, tears as weapons and becoming “the rain/storm.” There were also allegedly suspicious appearances by such renegade vocabulary as “tears,” “running,” “fire,” “rain,” “sky,” “love” and “invisible.” The court was not enchanted. The ruling said the claimed similarities amounted to unprotectable ideas, themes, metaphors, isolated words and short phrases. One claim compared Swift’s “The Great War” with a poem because both used fire-and-desire imagery; another argued that “The Man” infringed a poem because both involved a woman in a male-dominated work environment. The court also found the plaintiff failed to plausibly allege copying or substantial similarity and closed the case after concluding another rewrite of the complaint would be futile. Global News reported that the plaintiff plans to appeal.
