In Case No. 2025-03300 , the New York Supreme Court, Appellate Division, Second Department, modified a lower court ruling in a lawsuit brought in part under the state Adult Survivors Act. The employee alleged that a supervisor sexually abused the employee for more than nine years while working at Goodyear retail stores. The appeals court said claims alleging negligent retention, training and supervision and negligence did not allege an intentional tort committed, instigated or authorized by Goodyear and were therefore barred by the exclusivity provisions of the state Workers’ Compensation Law to the extent they were based on acts after the employee turned 18. The court also dismissed the post-majority intentional infliction of emotional distress claim against Goodyear, finding that the alleged sexual assaults and employees’ alleged failure to report them were outside the scope of their employment. The panel separately dismissed a demand for punitive damages under the negligent retention, training and supervision claim against Goodyear. The panel, though, allowed the post-majority hostile work environment claim against Goodyear to proceed, saying the complaint sufficiently alleged that managers and supervisors knew or should have known of the conduct and that their inaction could indicate condonation or acceptance.
