But their disappointment wasn’t enough to keep a lawsuit against Hershey alive. A federal judge in Miami dismissed the proposed class action, finding the consumers lacked standing to claim they overpaid for peanut butter-and-chocolate pumpkins without the carved eyes and mouths pictured on the packaging, Reuters reported Thursday. Plaintiffs Nathan Vidal and Eduardo Granados said they bought the treats for the novelty of their decorative designs. What they got was considerably less expressive. The judge found their allegations amounted to subjective disappointment. They had not alleged the candy was defective, worthless or had lost all economic value because it lacked the decorations, according to Reuters. Their attempt to establish a price premium also fell short. The plaintiffs cited prices at Target, Walmart and Hershey’s online store to argue they paid up to 25% too much. The problem: They bought their pumpkins at Publix. Hershey argued in a court filing that its packaging identified the carvings as a decorating suggestion and that reasonable consumers would not view the illustration as a guarantee. The company maintained that the buyers received the candy they paid for. The plaintiffs’ lawyer told Reuters they planned to appeal. Hershey declined to comment on the litigation.
