S.B. 3107 would amend Iowa law to raise the annual cap on reimbursements paid from the second-injury fund to the state attorney general’s office, doubling from $450,000 to $900,000. The bill also would require the reimbursement amount to be adjusted annually based on changes in the Consumer Price Index, with adjustments rounded to the nearest $5. In addition, the proposal directs the Iowa Insurance Division to treat the reimbursed amount as an outstanding liability when determining the availability of funds under existing statutory thresholds. Iowa’s second-injury fund is designed to offset workers compensation costs for employers and insurers when an employee with a preexisting impairment sustains a compensable workplace injury that results in permanent disability. The fund is financed through assessments and is administered separately from individual workers compensation claims. The attorney general’s office provides legal services to the fund in litigation and related proceedings. The bill was referred to committee.
