A Franklin Circuit Court judge granted summary judgment to D1 Data Solutions, doing business as REFMED, in an order entered Sept. 1. The court ordered the department to provide the records within two weeks and awarded REFMED attorney fees and costs. REFMED requested the schedule in March. The department denied the request, citing proprietary American Medical Association billing codes, and directed the company to FAIR Health, which prepared the schedule under a state contract. According to the ruling, FAIR Health charged $75 for its least expensive package and $60 for each additional user at a single location. Its licensing agreement restricted copying and sharing. The court found that the schedule, which sets allowable charges for treatment of work-related injuries and occupational diseases, belongs to the department and carries the force of law. It rejected the department’s asserted disclosure exemptions, noting that REFMED also held its own license for the billing codes. The judge found the department willfully withheld the records without plausible justification and could not use a private contractor to circumvent public records requirements.
