A. 11714, introduced Wednesday, would require employers, insurers and self-insured employers to pay 3% monthly interest on unpaid medical payment awards if they fail to pay within 15 days of a Workers’ Compensation Board award. Interest would begin accruing on the 16th day and continue until the award is paid in full. The measure would retain the existing provision allowing interest of up to 1.5% per month on medical bills determined to be due and owing. Medical providers and suppliers could also ask the board to determine whether a payer has engaged in a pattern or practice of nonpayment. If the board finds such a pattern and determines payment is owed, it would be required to award interest of between 3% and 5% per month, based on the severity, duration and frequency of the conduct. For egregious or repeated violations constituting a pattern of nonpayment, the board could impose an additional civil penalty of up to 25% of the amount owed, payable immediately. The bill would define a pattern or practice as three or more violations within 12 months, or other repeated conduct demonstrating a systemic failure to comply, including recurring late payments or untimely denial notices. The measure is pending before the Assembly Labor Committee and would take effect immediately if enacted.
