In Eckenrode v. D.C. Police & Firefighters Retirement & Relief Board , the District of Columbia Court of Appeals dismissed Alicia Eckenrode’s petition, holding that it lacked jurisdiction to directly review the retirement board’s decision. The ruling did not address whether the board correctly denied the benefits. Her husband, a Metropolitan Police Department sergeant, injured his knee on duty in 2006 and underwent a third knee surgery after it buckled at work in 2019. He was diagnosed shortly afterward with deep vein thrombosis and died in April 2020 from a pulmonary embolism caused by a blood clot. The board awarded Ms. Eckenrode a standard survivor annuity equal to 40% of the officer’s pay but denied enhanced benefits consisting of a $50,000 lump-sum payment and an annuity equal to his full pay. The board found insufficient evidence that his death was the “sole and direct result” of his work-related knee injury. The appeals court said applicants for enhanced survivor benefits are not constitutionally entitled to a trial-type hearing before the board. Because the proceeding was therefore not a “contested case,” Ms. Eckenrode must challenge the decision first in D.C. Superior Court, the majority held. A dissenting judge said the board should have conducted an evidentiary hearing allowing Ms. Eckenrode to question the medical evidence and cross-examine experts.
