Gerard Mulligan, a carpenter for Moy Construction, was assigned to work on an animal shed when the owner’s spouse, also the company’s vice president, asked him to help return a loose donkey to the structure. Mr. Mulligan subsequently experienced chest pain, lightheadedness, and vomiting and sought benefits for a heart attack he attributed to physical strain at work, according to Matter of Mulligan v. Moy Construction Corp. , decided by the Appellate Division, Third Department. A workers compensation judge found that the employer and its insurer missed the deadline to contest the claim but denied benefits, concluding that Mr. Mulligan had not established a work-related injury and noting the absence of emergency room records. The Workers’ Compensation Board reviewed the records in the case file and established the claim. The appeals court affirmed, finding sufficient unrebutted medical evidence connecting the heart attack to Mr. Mulligan’s work. He testified that he exerted himself while preventing the donkey from escaping again, and his treating physician linked the heart attack to that exertion. The court said the insurer’s late filing barred it from offering testimony disputing causation, although Mr. Mulligan still had to establish the connection through medical evidence. The court declined to consider the insurer’s separate argument that its policy did not cover Mr. Mulligan because it had not raised that issue before the compensation judge or board.
