The decision, in Hudson Specialty Insurance Company v. Mark Hormuz Dean, D.O., et al. , was issued Wednesday by the Western District of Virginia. Hudson Specialty is a subsidiary of Odyssey Group Holdings, based in New York. Dr. Dean owned and operated two medical practices in Charlottesville, Virginia, both insured by Hudson under professional and general liability policies. In 2019, a patient alleged Dr. Dean sexually assaulted her during treatment. In 2023, he pleaded guilty to four counts of object sexual penetration involving that patient and others and is currently incarcerated, according to the ruling. Hudson said it owed no defense, pointing to renewal forms Mr. Dean signed from 2011 through 2014 in which he answered “No” to a question asking whether any claim had ever been brought against him for alleged sexual misconduct. In discovery, Hudson found a 2010 demand letter and $100,000 settlement Dr. Dean paid to resolve a separate sexual assault claim. The settlement predated each of his “No” answers. Dr. Dean said his “No” answer was not false because he denies all allegations of sexual misconduct. But “the question did not ask if he had committed sexual misconduct — it asked if a claim was brought against him for alleged sexual misconduct,” the judge wrote. The sexual assault victim argued that Hudson has a duty to defend Dr. Dean’s medical practices against claims of negligence, but the judge found that Dr. Dean’s omissions voided the policies of the practices as well as Dr. Dean.
