Ruthless Studios has sued production companies Dark Age Cinema and Art the Clown in federal court in California, alleging copyright infringement, trademark infringement, unfair competition and unauthorized profits tied to the Terrifier franchise, according to a report by Complex. At issue are agreements allegedly signed in 2013 between filmmaker Damien Leone and Ruthless Pictures, whose rights were later assigned to Ruthless Studios. The lawsuit claims Leone transferred ownership of the original Terrifier and The 9th Circle short films — along with copyrights, trademarks, sequel rights and derivative works — for $5,000. Ruthless claims it financed and produced the 2013 anthology film All Hallows’ Eve , which included both shorts and helped turn Art the Clown into a horror icon. The company says it later allowed Leone to make a low-budget Terrifier film as a one-time exception, but was cut out as Terrifier 2 and Terrifier 3 followed, along with merchandise deals and brand expansion. The suit argues the later films are derivative works or sequels based on shared characters, themes, visual style and branding. Ruthless is seeking damages, an accounting of profits, an injunction and a declaration that it owns rights to Terrifier 2 , Terrifier 3 and related sequels, merchandise, video games and events — all excluding the 2016 film.
