Lawmakers in 2019 enacted a measure allowing first responders to file PTSD claims for specific incidents, including seeing a dead child or witnessing a traumatic physical injury. In 2023, they passed a law allowing all workers who experience a qualifying event to receive PTSD benefits. H.B. 5279 would expand the list of qualifying events to include witnessing a serious physical injury that does not result in death or loss of a body part or function resulting in permanent disfigurement. The bill would define “serious physical injury” with a cross-reference to a statute that defines the phrase to mean physical injury that creates a substantial risk of death or that causes serious disfigurement, serious impairment of health, or serious loss or impairment of the function of any bodily organ. H.B. 5274 would order the Workers Compensation Commission to study the state’s system, finalize a report on its findings and recommend legislation by Jan. 1, 2027. The joint Labor and Public Employees Committee is scheduled to hear testimony on the measures during a public hearing Tuesday. WorkCompCentral is a sister publication of Business Insurance.
