The lawsuit claims Millennium Cabaret used photos of the women to promote the club, allegedly giving customers the impression that Ms. Electra or the other models endorsed the place, were affiliated with it, or might be stopping by. According to the suit, they were not. An intellectual property attorney told WMUR the case centers on the Lanham Act, a federal law usually used in trademark disputes and makes the argument is that famous faces can function a little like brands. The models’ attorney declined to comment. The club’s Florida-based owner said the business does not believe the lawsuit has a basis, which is legal-speak for “we’ll see you in court.” Ms. Electra and some of the other models have also sued clubs in New York and Massachusetts over similar claims.
