Lawyers representing State Farm in a Los Angeles lawsuit have apologized after discovering that AI helped sprinkle their court filings with nonexistent cases, inaccurate case titles and quotations that could not be found in the decisions cited, according to CalMatters, a nonprofit news site. The problem surfaced in litigation brought by a homeowner over the rebuilding of her fire-damaged home. Her attorney said State Farm’s filings contained “cases that do not exist, quotes that do not exist, and holdings that do not exist.” An attorney with Musick, Peeler & Garrett later acknowledged that seven case citations appearing across eight filings simply did not exist. She said she had used an AI tool called Irys, mistakenly believing it was connected to the firm’s Westlaw subscription, and that it had performed an internal citation check. Spoiler: It did not. The lead trial counsel told the court he had not known AI was used but accepted responsibility for the filings. He said the firm has since updated its AI policy. State Farm, meanwhile, said it is reviewing what happened and expects outside counsel to verify the accuracy of legal filings.
