Acrisure alleges Mr. Papazyan violated noncompetition and nonsolicitation agreements tied to the 2020 sale of his Gain Insurance Agency brokerage and his later employment agreement with Acrisure. Mr. Papazyan resigned in April and joined Howden, which Acrisure said hired 25 former Acrisure employees in a “Team Lift Out.” At least five Acrisure customers that Mr. Papazyan serviced have since indicated that they are moving brokers, court papers say. U.S. District Judge Jane Beckering ruled Tuesday that Howden failed to meet the requirements for intervention, finding it was not a party to the contracts at issue and had only a “generalized, commercial interest” in the dispute. The court previously issued a temporary restraining order and, following a May 26 hearing, granted Acrisure’s request for a preliminary injunction. Meanwhile, a federal judge in California denied Mr. Papazyan’s request for a temporary restraining order that would have barred Acrisure from enforcing the restrictive covenants or interfering with his employment at Howden. U.S. District Judge John Kronstadt said granting the request would conflict with rulings already entered in the Michigan case.
