That lesson is getting an update after an expert witness in litigation over a deadly Houston-area explosion used ChatGPT to help prepare significant portions of his expert report, according to reporting by 404 Media highlighted in a New York Magazine column. The expert was testifying in litigation over an explosion that killed three people and destroyed roughly 200 homes. According to the reporting, his ChatGPT prompts included a request to help “create an exceptional expert witness report” defending 3M’s standard of care and to show that 3M was “0% at fault” for the explosion at Watson Grinding. That’s one way to tell the chatbot where you’d like the evidence to land. The event highlights a growing litigation risk as AI chat transcripts enter civil and criminal proceedings. New York Magazine compares it with the dawn of email discovery, recalling the federal government’s 1998 antitrust case against Microsoft, when internal emails became key evidence and companies quickly learned that electronic messages were both permanent and discoverable.
