In Jonathan Mohler v. Robert A. Young III dba Cross Creek Ranch LLC; Midwest Insurance Co., the Court of Appeals of Arkansas ruled Tuesday that Mr. Mohler sufficiently proved that his illness arose out of his job on a cattle ranch. Mr. Mohler worked outdoors tending livestock, repairing fences and baling hay on a 1,000-acre ranch, where he also lived in employer-provided housing. He said tick bites were common during his work. In late 2022, he became ill and was later diagnosed with alpha-gal syndrome. The tick-borne condition causes severe allergic reactions to mammalian meat and neurological and digestive symptoms. He claimed workers comp benefits and an administrative law judge found the condition compensable, but the Arkansas Workers’ Compensation Commission reversed, ruling that Mr. Mohler failed to prove his illness was work-related. The appeals court disagreed, finding that the ranch hand’s job placed him at far greater risk of tick exposure than the general public. “Nothing in the record suggests an alternative explanation for Mohler’s development of AGS,” the court wrote. A lawyer for the ranch and the insurer declined to comment on the ruling.
