In Vega v. Grafton Correctional Facility , the Ninth District Court of Appeals ruled in favor of employee Nancy Vega, finding her shoulder injury arose out of her employment despite no clear cause for the fall. Ms. Vega was injured while walking between rooms at work when her foot “gripped the floor” and she lost her balance, falling into a wall. She identified no hazard or defect that contributed to the incident. The Ohio Bureau of Workers’ Compensation and the employer argued the injury was not compensable because there was no evidence of a workplace hazard and the fall was unexplained. The court rejected that argument, applying Ohio Supreme Court precedent on “unexplained falls,” which are considered neutral risks. Under that framework, once an employee shows the fall occurred in the course of employment and eliminates personal or idiopathic causes, an inference arises that the injury is work-related. The court found Ms. Vega met that burden and noted the employer failed to present evidence of a personal condition or other non-work-related cause. Because the fall occurred on the employer’s premises while she was performing job duties, and no idiopathic cause was identified, the court held the injury was compensable.
