According to reporting by The New York Times, lawyers on both sides of a breach of contract case cited nonexistent cases in court filings, the kind of AI mishap now politely called “hallucinated” citations. The case involved a Louisiana lawyer who claimed he was not paid legal fees by the city of Aberdeen, Mississippi, in connection with a solar power development project. But before anyone could argue about who owed whom, the court had to deal with a more pressing issue: both sides had submitted filings containing fake legal authorities. The judge, in removing all four lawyers from the case and canceling the civil trial, wrote that the case presented an unusual scenario because attorneys for both litigants engaged in similar sanctionable conduct. This keeps happening despite a growing stack of cautionary tales involving lawyers caught using AI-generated fake cases. In this recent case, two lawyers were barred for two years from appearing in the U.S. District Court for the Northern District of Mississippi. One was fined $2,500 and the other $3,500. Two Mississippi lawyers who sponsored their temporary admission and signed the filings were each fined $1,000. One lawyer reportedly told the court she did not know AI could hallucinate cases.
