The report, based on claims data from Aon clients, showed that claim frequency and severity were rising. North American representations and warranties recoveries by Aon clients exceeded $440 million in 2025, while median payments topped $8.2 million, the report said. The average North American payout in 2025 was over $10 million, the second-highest figure ever. Globally, more than $1 billion was recovered. The study is based on data from nearly 2,000 claims, Aon said. Legal compliance was the most frequent claim type, accounting for more than 20% of notifications. Material contracts, financial statements and tax breaches each represent more than 10% of notifications. North American deal size was an important variable, the broker said, citing a Morgan Stanley report showing a sharp increase in transactions valued at more than $1 billion. The average enterprise value on Aon deals in North America increased 73% in 2025 compared with 2024, the report said. Marsh issued its transactional risk insurance claims report last week.
