The expedited order in Thacker v. 567 Partners Inc. found that the worker was likely to prove at a hearing on the merits that his injury arose primarily out of and in the course and scope of his employment. The plumber testified that he injured his left leg on a ladder being carried by a co-worker while descending stairs at a crowded job site in August 2025. He subsequently developed an infection that required extensive hospitalization. 567 Partners Inc. disputed the claim, citing evidence that the worker had previously said he injured his leg in a fall from his porch at home. Co-workers also testified that they saw him push a pocketknife into his leg and pour cola on the wound. The court found that the workplace incident and the pocketknife incident occurred. However, the only medical opinion in the record linked the infection and hospitalization to the workplace incident. Because the doctor had not been asked whether the pocketknife incident would alter his causation opinion, the court said it could not speculate about the effect of that evidence. The judge designated the physician as the worker’s authorized treating doctor and ordered 567 Partners and Frankenmuth Mutual Insurance to provide reasonable and necessary medical treatment. The court denied temporary disability benefits because the worker did not present sufficient evidence of total disability, a causal connection between the injury and his inability to work, or the duration of his disability. His request for attorney fees was denied at this stage.
