Federal Insurance Company , was handed down Friday after a four-day trial in the U.S. District Court for the Southern District of West Virginia. Jurors set damages at $27.5 million for economic loss and the rest for aggravation and inconvenience. In 2018, a hopper in a silo at Ramaco’s West Virginia coal operation collapsed and shut down operations. Federal denied the claim, the failure was caused by corrosion, which the policy did not cover. Ramaco argued a clog of coal inside the silo was to blame. It sued in August 2019. A first trial ended with a $7.6 million award for lost income and costs and $25 million under West Virginia’s Hayseeds doctrine, which lets a policyholder that “substantially prevails” against its insurer recover additional damages. In that trial, Ramaco’s chief operating officer testified that Federal’s coverage denial drove the company to the brink of bankruptcy, according to court documents. The trial judge later cut the contract award to $1.8 million and threw out the $25 million. But in 2023, the U.S. Court of Appeals for the Fourth Circuit reinstated the $7.6 million. It held that Ramaco was entitled to Hayseeds damages but ordered new trial on those damages. The panel agreed the $25 million must have been partly punitive, which the doctrine does not allow, given the limited evidence offered. The latest verdict resolves two of the three elements of damages. The court will decide attorney’s fees later, according to a Ramaco news release on the verdict.
