In Courtney v. Meyer , the unanimous court affirmed summary judgment for Kenneth Meyer, who was training Dusty Courtney at Wyoming Waste Systems when the August 2023 accident occurred. Mr. Courtney had exited the running truck because he felt ill. While seated in the passenger seat, Mr. Meyer activated controls to raise the truck’s unstowed lift arms after looking through the passenger-side window. He did not know that Mr. Courtney had placed his hand in a pinch point on the driver’s-side lift arm. Mr. Courtney argued that Mr. Meyer acted willfully and wantonly by operating the controls without determining his location and by violating several safety rules. The state high court said the evidence could support a negligence claim but did not show that Mr. Meyer knew of a specific danger creating a high probability of injury. General knowledge that a pinch point could cause harm and evidence of safety violations were insufficient to overcome the immunity provided to co-employees under Wyoming’s Workers’ Compensation Act. The court also said Mr. Meyer’s prior safety infractions and alleged callous behavior after the accident did not establish willful misconduct in causing the injury.
