Lawyers for both sides in Rising Pharma Holdings Inc. and Casper Pharma v. Westchester Surplus Lines Insurance Company informed the U.S. District Court for the District of Delaware on Monday that they have reached the settlement. They plan to request dismissal of the case pending “satisfaction of conditions involving a non-party to this action as set forth in the settlement.” Casper and Rising Pharma are affiliated companies based in East Brunswick, New Jersey. Casper has been named in three lawsuits alleging its drug Allopurinol, sold as Zyloprim, caused severe skin reactions known as Stevens-Johnson syndrome and toxic epidermal necrolysis. In one of them, the patient had died. In its February 2025 complaint, Rising Pharma and Casper Pharma alleged that primary insurer Westchester offered to cover one of the lawsuits in 2022 but did not assign defense counsel until eight months later and then denied coverage in 2024, citing a “Batch Occurrence Endorsement” that treats related claims as arising from a single occurrence. It denied coverage in a second lawsuit on the same basis and did not issue a position on the third, according to the complaint. Liberty Mutual unit Ironshore Specialty and Nationwide Mutual unit Scottsdale Insurance were excess insurers also named in the suit.
