A. B. 10413, referred to the Assembly Labor Committee, seeks to amend the state’s workers compensation law relating to access to medically necessary prescriptions. The legislation would permit claimants to use a pharmacy outside a contracted network under certain circumstances, including when an authorized medication is not dispensed by a network pharmacy within required timeframes, when an employer or insurer fails to issue authorization decisions on time, or when emergency medication is needed to prevent imminent harm to a worker’s health or safety. The measure also would allow out-of-network access when other circumstances specified by the state’s workers compensation regulators indicate delays that could impede recovery. Lawmakers said the proposal aims to codify regulations adopted by the New York State Workers’ Compensation Board that took effect in July 2025, addressing access to out-of-network pharmacies. Making the protections law would provide permanence and consistency while preserving the board’s authority to adjust rules as medical and pharmaceutical delivery systems evolve, according to the bill’s legislative findings. Under the bill, pharmacies dispensing medication outside a network would still be required to comply with the state’s workers compensation pharmacy fee schedule, treatment guidelines and formulary requirements. If a claim is later denied or the medication is deemed non-compensable, the dispensing pharmacy would assume financial responsibility for the cost, the proposal states. The measure would take effect 60 days after becoming law. It also requires the Workers’ Compensation Board to report to state leaders within three years on how the policy affects medication access, litigation, and system costs.
