A.B. 2137 would require the Department of Industrial Relations, or Cal/OSHA, to develop an application and certification process for businesses engaged in “slab solid surface product fabrication activities.” The measure targets fabrication work involving materials such as artificial stone, granite and marble, where cutting and grinding can generate respirable crystalline silica — a known cause of silicosis and other lung diseases. Under the proposal, the state would establish a formal certification program by Jan. 1, 2028, with three-year certifications issued to shops that demonstrate compliance with workplace safety requirements, including air monitoring, proper dust control and valid workers compensation coverage. Beginning July 1, 2028, businesses would be prohibited from performing fabrication activities unless they are certified or have a pending application, with violations subject to citations and civil penalties. The bill would also extend compliance obligations across the supply chain. Suppliers would be required to verify that customers performing fabrication are certified, while contractors hiring fabrication services would need to confirm certification status before providing materials. In addition, the measure would require the state to track enforcement data and health outcomes, including citations related to silica exposure and reported cases of silicosis among workers. Fees collected under the program would be deposited into a newly created Slab Fabrication Activity Account to fund enforcement and administration.
