In Nationwide General Insurance vs. Samsung Electronics America, Inc. , the insurer asks Samsung to pay at least $653,000 to repair a North Carolina home set ablaze in 2022. Nationwide claimed Samsung negligently designed the stove, failed to warn users of its dangers and breached the claims of its warranty. Samsung’s lawyers said the homeowners failed to make clear in their complaint how the stove was activated, because no one was at home at the time of the fire. In an order signed Thursday, Judge James C. Dever III said Nationwide’s “claims are plausible” and denied Samsung’s motion to dismiss its claim. The U.S. Consumer Product Safety Commission recalled 1.1 million Samsung slide-in electric ranges in August 2024, saying they had caused about 250 fires and 40 injuries. The stove’s front-mounted control knobs could be accidentally activated by people or pets, and at least seven pets had been killed, the commission reported. A class-action suit pending in the U.S. District Court in the Eastern District of Tennessee claims that Samsung kept selling the stoves despite knowing about the defect.
