A man has filed suit against the sporting goods giant in Utah federal court, alleging the sports company misled consumers by advertising certain baseball and fastpitch bats as certified for organized league play without clearly disclosing how those certifications were obtained, as reported on topclassactions.com. According to the complaint, filed by plaintiff Brian Duryea and accessed by the website, the issue comes down to whether the bats were approved through performance testing or whether Rawlings simply told certifying bodies the newer models were only cosmetic updates of previously approved bats. That distinction matters, Mr. Duryea argues, because players and parents often rely on those certifications to make sure the bat is legal for league use and thus worth the often hefty price tag. The lawsuit claims consumers were led to believe they were buying bats with meaningful performance upgrades, while Rawlings allegedly represented to certification organizations that the bats had only cosmetic changes from older approved models. The complaint includes claims for unjust enrichment, negligent misrepresentation, fraudulent misrepresentation, and breach of express warranty, and seeks compensatory and punitive damages along with injunctive relief.
