In an expedited order issued March 10, the Tennessee Court of Workers’ Compensation Claims said truck driver Stephen Jablonski is likely to prevail at trial in his request for a panel of joint-replacement specialists to evaluate whether he needs knee-replacement surgery. While working for Swift Transportation Co. of Arizona, Mr. Jablonski suffered fractures to his right tibia and fibula after slipping on ice, requiring surgery that involved a bone graft and hardware placement in the knee joint. Although he initially improved, he later developed post-traumatic arthritis and continued to experience pain and limited mobility. His authorized treating physician referred him to an adult reconstructive orthopedic surgeon to determine whether knee-replacement surgery was appropriate, citing the complexity of replacing a knee that already contains surgical hardware. Instead of authorizing the referral, Swift provided Mr. Jablonski with a panel of general orthopedic surgeons, one of whom did not perform knee-replacement surgery. The judge ruled that under Tennessee law an employer must either authorize the referral or provide a panel of physicians qualified to address the specific specialty identified by the treating doctor. The court ordered Swift to provide a panel of joint-reconstruction orthopedic surgeons within seven business days and referred the company and its insurer to the state Bureau of Workers’ Compensation compliance unit for potential penalties related to the delay in providing appropriate treatment.
