In a decision and order dated April 29 in Century Indemnity Co. et al. v. The Archdiocese of New York et al. , retired Justice Rosalyn Richter denied a motion by Century Indemnity, a unit of Chubb, seeking a protective order to block Mr. Greenberg’s deposition in the New York State Supreme Court litigation. The Archdiocese of New York alleges insurers improperly denied coverage for claims brought under New York’s Child Victims Act and contends Mr. Greenberg was involved in decisions related to the coverage dispute and related public relations efforts. Century argued the court should apply the “apex doctrine,” which limits depositions of senior corporate executives unless they possess unique relevant knowledge. But Justice Richter said New York discovery rules are broad and do not require parties to show the information cannot be obtained elsewhere. The ruling cited documents suggesting Mr. Greenberg may have been involved with Mercury, a public relations company the archdiocese says played a central role in external communications tied to the dispute. “A CEO in a position such as the one held by Mr. Greenberg should not expect to be insulated from questioning about his actions in a case as significant as the one here. Thus, no basis exists to preclude the deposition which is about the business decision making process and whether any bad faith was involved,” Justice Richter wrote. The referee granted a protective order blocking the deposition of Chubb General Counsel Joseph Wayland, finding questioning would likely implicate privileged communications. Chubb did not immediately respond to a request for comment.
