H.B. 840 would classify transportation network company drivers as employees for workers compensation purposes while they are engaged in “passenger platform time” and “dispatch platform time,” meaning while transporting passengers or traveling to pick them up. Transportation network companies would be treated as employers during those periods only. The measure would require transportation network companies to pay quarterly premiums into Ohio’s state insurance fund based on the total passenger and dispatch platform time logged by drivers, using rates established for taxicab companies or similar industries. Beginning Jan. 1, 2027, the bill would also set minimum compensation standards for drivers. For trips originating in cities with populations greater than 600,000, companies would have to pay the greater of 59 cents per passenger platform minute plus $1.38 per passenger platform mile, or $5.17 per trip. For trips elsewhere, the minimum would be 34 cents per minute plus $1.17 per mile, or $3 per trip. Tips would be excluded from minimum compensation calculations and must be remitted in full to drivers. The legislation would further require companies to provide drivers with electronic receipts detailing pay, mileage, deductions and tips, along with weekly pay summaries and notices of workplace rights. It would also prohibit retaliation against drivers for filing complaints or exercising rights under the law. The Ohio Department of Commerce would investigate complaints and could impose civil penalties for violations, including unpaid compensation, unlawful deductions and retaliation.
