In Braboy v. US Foods Inc., the Tennessee Court of Workers’ Compensation Claims ruled that the employee suffered a compensable injury and was entitled to enhanced benefits beyond standard limits. The worker, a long-time delivery driver, injured his back in March 2023 while moving a pallet to bridge a height gap between a trailer and loading dock. Medical evidence showed a herniated disc requiring lumbar fusion surgery. His treating physician assigned a 13% impairment rating with permanent restrictions. The employer argued that the condition was primarily due to preexisting degenerative issues, relying on citing an independent medical examiner who said he could not attribute the injury mainly to the work event. The court, however, found the treating physician’s opinion more convincing, noting he had reviewed all imaging and treated the employee over time, while the employer’s expert conducted only a single evaluation without access to all records. The court concluded the worker proved causation to a reasonable degree of medical certainty and established a new, distinct injury rather than a continuation of prior conditions. The court also determined the case met the statutory threshold for “extraordinary relief,” citing the employee’s inability to return to his long-time occupation, lack of transferable skills and significant physical restrictions. The employee, who had worked as a truck driver for nearly four decades, had not returned to work and was receiving Social Security disability benefits. The court awarded 275 weeks of benefits totaling $306,190.50, along with future medical expenses and costs. It also referred the employer for possible penalties after finding it failed to provide a required panel of physicians.
