Reforms in A.B. 651 also reverse a state Supreme Court decision allowing the stacking of disability percentages and clarify that the statutory deadline for filing occupational disease claims cannot be tolled indefinitely. Gov. Evers said the measure reflects recommendations of the Workers’ Compensation Advisory Council and is aimed at improving benefit adequacy, efficiency and program integrity. The bill raises the maximum permanent partial disability benefit to $454 per week, increasing to $462 in 2027. It also overturns the 2007 ruling in DaimlerChrysler v. Labor and Industry Review Commission , which had allowed combining disability ratings from multiple procedures on the same body part. Under A.B. 651, ratings from repeat procedures on the same limb can no longer be aggregated. The measure expands the state’s supplemental benefit program to include workers injured before Jan. 1, 2020, and ties payments to 2020 benefit levels with annual adjustments. It also broadens eligibility for post-traumatic stress disorder claims, allowing part-time and volunteer firefighters and emergency medical responders to seek benefits without a physical injury. The bill clarifies that the 12-year deadline for occupational disease claims cannot be extended indefinitely and increases penalties for employers that fail to carry coverage or misrepresent insurance, with fines reaching up to $4,000 for repeat violations.
