H.B. 466 would amend several sections of the Alabama Code governing firefighter benefits and occupational disease presumptions. Under the proposal, Parkinson’s disease would be added to the list of conditions presumed to arise out of a firefighter’s employment if the firefighter can demonstrate exposure to a toxin associated with an increased risk of the disease while on the job. Alabama law currently recognizes several firefighter occupational diseases, including hypertension, heart disease, respiratory disease, certain cancers, HIV and hepatitis. If Parkinson’s disease meets the qualifying criteria under the bill, it would be presumed to have occurred in the line and scope of employment, meaning firefighters could qualify for disability benefits or death benefits for their dependents under existing state and municipal benefit programs. To qualify, firefighters would generally need to have passed a physical examination upon entering service that showed no evidence of occupational disease and completed at least three years of service. Under the legislation, employers or the state could rebut the presumption by demonstrating by a preponderance of the evidence that the disease was caused by factors unrelated to the firefighter’s occupation. If enacted, the bill would take effect Oct. 1, 2026.
