In Michael Januszewski v. North Dakota Workforce Safety and Insurance , the state high court affirmed a district court ruling that upheld an administrative law judge’s decision imposing a statutory forfeiture penalty. Mr. Januszewski challenged the finding that his statements were willful and argued that Workforce Safety and Insurance failed to prove they were material. The Supreme Court said the administrative law judge’s findings were supported by a preponderance of the evidence. The court declined to consider Mr. Januszewski’s remaining arguments because he failed to support them with citations to the record, legal reasoning or relevant authority. The ruling did not identify the statements Mr. Januszewski made or provide details about his underlying injury.
