The Senate on Wednesday signed off on amendments made to S.B. 184 while the measure was in the state House of Representatives, which passed the bill Tuesday. The bill would enumerate a list of cancers that are presumed to arise out of employment for firefighters who have at least five years of cumulative full- or part-time service. The presumption statute currently covers cancer of the brain, skin, digestive system, hematological system or genitourinary system. The proposal lists 19 types of covered cancers, including organ-specific conditions and mesothelioma, leukemia and non-Hodgkin’s lymphoma. Amendments adopted in the House removed language that would have added Parkinson’s disease to the list of conditions presumed to arise from employment. They also removed an earlier proposal to define covered conditions with site-specific classifications that include malignant neoplasms affecting the oral cavity, respiratory system, digestive tract, lymphatic and hematologic systems, and a range of additional organs. Employers could rebut the presumption with clear and convincing medical evidence that the condition was caused solely by nonoccupational causes. The House on Tuesday also voted 65-0 to pass S.B. 186, which would update definitions for “mailing” and “service” to include electronic transmissions, including email and submitting documents through the Division of Workers’ Compensation electronic filing system. The bill has not been edited since the Senate passed it earlier in May. Both measures can be transmitted to the governor, who can sign them, veto them or allow them to become law without a signature.
