The additional discovery includes information potentially contained on personal electronic devices of former Brown & Brown employees who joined Howden. Howden had sought an extension until Sept. 25, but Judge Debra Squires-Lee of Suffolk County Superior Court allowed the extension through Oct. 16, according to a handwritten note on the motion following a Sept. 10 hearing. Brown & Brown on Sept. 2 filed a motion opposing giving Howden additional time, arguing that the rival brokerage had already failed to meet court-ordered discovery deadlines. Howden produced 14,588 documents on Aug. 21, more than the 13,433 documents it had produced during the preceding seven months, according to Brown & Brown. Howden had said it needed additional time to collect and review information potentially stored on personal electronic devices of former Brown & Brown employees who joined Howden. Expanded discovery had generated about 4,300 new search terms, and about 125 of 270 former Brown & Brown employees who joined Howden said they potentially used personal devices to communicate with clients, according to Howden. Brown & Brown said on its second-quarter earnings call that it expects the full-year 2026 revenue impact related to new and lost business and incentives stemming from the departures to total $50 million to $60 million. Howden has hired hundreds of employees from rivals since launching its U.S. retail brokerage operation last year .
