In 2022, the federal Occupational Safety and Health Administration launched the national emphasis program, allowing the agency to inspect high-risk workplaces to prevent heat-related injuries and deaths. The program resulted in about 7,000 inspections in industries with high risks of exposure to extreme heat. Jessica E. Martinez, executive director of the National Council for Occupational Safety and Health, said allowing the program to expire at the start of summer is dangerous and unacceptable. Providing workers with water, shade, rest breaks and acclimatization periods are simple, evidence-based steps to reduce heat-related injuries. “But without a standard, they are not guaranteed,” Ms. Martinez said. “They are not enforceable. When OSHA steps back, workers are left exposed to preventable harm.” The end of the program doesn’t eliminate federal oversight of heat hazards. OSHA can still cite employers under the Occupational Safety and Health Act’s general duty clause, which requires employers to maintain a workplace free from known hazards and serves as a catch-all for situations not covered by specific standards. OSHA is also in the process of developing a nationwide heat standard. Rules proposed in 2024 advanced through public hearings in 2025 and remain under review. OSHA has not publicly indicated its plans for heat safety rules going forward. States including California and Washington already enforce their own heat-specific safety standards. Other states rely primarily on federal standards. Texas in 2023 and Florida in 2024 passed laws prohibiting cities and counties from adopting labor rules or practices stricter than those enforced by the state or the federal government.
