In Kevin Koeller v. Cardinal Logistics Management Corp. and Ace American Insurance Co. , the high court affirmed in part and vacated in part a Court of Appeals ruling and remanded the case for further proceedings. Kevin Koeller worked as a semitruck driver for Cardinal Logistics and was injured Oct. 5, 2022, while unloading a truck. According to the ruling, a pallet had fallen inside the truck and jammed a roll-up door. When Mr. Koeller pulled on the door handle, he felt a popping sensation in his left shoulder. He later underwent shoulder surgery that included a distal clavicle excision, or removal of part of the clavicle bone. A physician retained by Mr. Koeller assigned a 19% permanent impairment rating to the left upper extremity, including 10% for the distal clavicle excision. The deputy workers compensation commissioner accepted the physician’s medical opinions but reduced the overall impairment rating to 13%, finding that the 10% rating had to be multiplied by a 25% value under another table in the AMA Guides. The commissioner and district court upheld that approach. The Supreme Court disagreed, holding that the AMA Guides do not require use of the 25% multiplier for a distal clavicle excision. The court said the commissioner had authority to review an expert’s interpretation of the guides, but erred in concluding that the multiplier applied. The court also rejected Cardinal’s argument that the commissioner should have credited the treating physician’s lower impairment opinion, saying the commissioner generally decides which expert testimony to accept.
