H.B. 5385, introduced Thursday and referred to the Joint Committee on Labor and Public Employees, would direct the state Workers’ Compensation Commission to examine the causes of undue delay in such claims. Under the proposal, the commission would study factors contributing to delays, including administrative processing issues, medical provider availability and scheduling limitations, and insurer authorization requirements. The bill specifies that the review is not limited to those categories, leaving the commission discretion to identify additional sources of delay affecting police officers and firefighters. Not later than Jan. 1, 2027, the commission would be required to report its findings to the General Assembly’s joint standing committee with jurisdiction over labor and public employees matters, in accordance with statutory reporting requirements. According to the statement of purpose, the measure is intended to require the commission to study undue delay in workers compensation claims filed by police officers and firefighters. If enacted, the bill would take effect upon passage.
