A New Orleans judge learned that lesson after seeking criminal charges against a television station under provisions of a Louisiana law that had already been repealed, according to The Guardian. Criminal court Judge Kimya Holmes filed a police complaint against CBS affiliate WWL Louisiana after its reporting included her home address and vehicle information. She told police the report put her in danger. The underlying story examined a $765,000 home donated to the judge by her then-fiance, who had been charged with fraudulently collecting pandemic relief money. Judge Holmes maintained that she learned of his offenses around the time he pleaded guilty, after their relationship ended, the newspaper reported. A courthouse administrator demanded that WWL remove the address and a vehicle’s license plate number, citing provisions that threatened up to 90 days in jail and a $1,000 fine. The station took down videos and reposted them with the information blurred. Then its legal team checked the statute. The relevant provisions had been repealed effective Aug. 1 — before both the broadcast and the judge’s September complaint. The criminal case had encountered a technical difficulty: no applicable crime. According to the police report described by The Guardian, Judge Holmes said she had been unaware of the revisions and acknowledged that, if they were true, she had no grounds for a criminal complaint. Police closed the case without action against the station.
