Shein lost a London copyright lawsuit Thursday accusing Temu of using thousands of its clothing photos to piggyback on its better-established fast-fashion rival, Reuters reported. Shein alleged copying “on an industrial scale,” but a judge ruled that Temu did not infringe Shein’s copyrights and would not have been liable even if infringement had occurred. The judge found that Temu prohibited merchants from uploading infringing material and acted only as an intermediary for third-party sellers. She also said Temu lacked actual knowledge of the alleged violations. Shein originally claimed Temu had reproduced its photographs, but dropped that argument at trial because Temu’s servers are in Ireland and the copying therefore occurred outside the United Kingdom, according to the ruling. In other words, the photos may have traveled faster than the legal claim could keep up. The court also upheld Temu’s counterclaim for damages stemming from its removal of listings after Shein obtained an injunction involving images Shein did not own. The decision marked the first trial in the rivals’ global legal battle. Temu’s allegation that Shein violated competition law by locking suppliers into exclusive agreements is scheduled for trial next year. For online marketplaces, the ruling highlights the protection that can come with functioning copyright policies, prompt responses to complaints and a defensible claim that the platform is merely hosting sellers’ content.
